Back injury to worker yields $500,000 award

California employees in any industry deserve the right to know that their work environments are safe and that they will be protected in the event of workplace accidents. When an on-the-job accident happens, determining the cause is one of the steps to determining the appropriate level of compensation. For some people, workers’ compensation is sufficient but for other cases, more assistance is required.

The extent of a worker’s injuries directly affects what help is needed after a work accident. In the case of a 31-year veteran employee of the BNSF Railway Co., his injuries from an accident on the job were so great that he was rendered unable to continue in his profession. The man’s attorneys estimated that he had lost the ability to earn between $489,000 and $716,000 from the years he would have worked but no longer can.

The accident took place in October of 2006 when he was working on a crane and slipped, causing a severe back injury. Attorneys for the railroad company argued that his back problems did not really begin until 15 months later when he slipped at home. A jury recently awarded the victim $500,000 after only three hours of deliberating. They found the employer guilty of failing to provide both ample training and a safe workplace.
