California Supreme Court to weigh drug overdose compensation suit

People can get hurt at work in many different ways. Some injuries are more serious than others, and those types of injuries can even lead to long-term problems. However, anyone in the Van Nuys area who misses work time due to an on-the-job injury is probably eligible for workers' compensation.

The workers compensation case of a man who died after a prescription drug overdose is headed to the California Supreme Court. According to reports, the court has agreed to hear arguments in the case of South Coast Framing Inc. V. Workers Compensation Appeals Board. The news comes after a state district court of appeals originally ruled that the man’s death was not compensable. According to case records, the man fell off a roof while working for South Coast Framing in 2008.


He reportedly injured his head, chest, back and neck in the fall. The man’s workers’ compensation doctor prescribed him several different medications, and then in 2009 his primary care doctor prescribed him additional medication for sleeping problems and anxiety. According to reports, the man died the following year from complications from the combined effects of the medications. The man’s family reportedly filed for workers compensation benefits, but after originally be awarded the benefits, the district court overturned the ruling.

It will be interesting to see how the Supreme Court rules in this case and what impact it could have on future cases.
