Business ruled liable in woman's workplace accident

No one ever wants to get hurt at work, but the fact is accidents and injuries happen in the workplace every day. Although many companies and employers in Los Angeles fully cooperate in workers compensation matters, not all businesses or insurance companies like to comply. If you have been hurt in a workplace accident then you should be eligible to receive workers' compensation.

An appellate court has ruled that a casino must pay the workers’ compensation claim of one of its employees who was injured in a car accident while leaving work. The court ruled that because one foot of the woman’s car was still in the casino driveway when the accident happened, the casino was responsible for paying her compensation claim. The judge in the original trial had ruled in the woman’s favor, as well.

The casino claimed that it was not responsible for the accident in any way and that it does not share in liability because the woman and her vehicle were already in a public roadway at the time of the accident. The court ruled that the woman’s car was still technically in the casino’s driveway when her car was hit. According to the court a person is considered to still be at work until he or she has left the employment location

The judge in this case found that the casino was still liable for this woman’s injuries and therefore ordered the casino to pay her workers’ compensation claims.
