Medical reports from doctors outside of network ruled admissible

When someone in the Los Angeles County area suffers an injury at work he or she should be able to expect to receive a fair amount of workers' compensation benefits for any lost wages. However, not all businesses and insurance companies want to pay a fair amount of compensation. That’s why it’s important for anyone who is hurt on the job to understand his or her legal rights.

A California woman who was injured when she fell while working has received some good news in her ongoing battle to receive workers’ compensation for her injuries. The California Supreme Court has ruled that medical reports obtained from out-of-network doctors are indeed admissible as evidence in workers compensation cases in the state of California, despite her employer’s appeal.

A doctor in the company’s medical provider network originally treated Ms. Valdez for her injuries. However, she wanted a second opinion so she saw another doctor who was outside of her employer’s provider network. Her employer argued that those reports should not be admitted as evidence. The company appealed an appellate court’s decision that ruled that the reports were admissible, but the Supreme Court unanimously upheld the lower court’s decision.
