Two workers killed while inspecting train tracks in California

Everyone who is employed in the state of California is covered by the state’s workers' compensation system for any injury that occurs while on the job. Even if a person in the Los Angeles area is killed, then his or her family members may be eligible to receive compensation for the lost wages and other damages.

Two workers who were inspecting the tracks of a Bay Area Rapid Transit (BART) system were killed recently when a train struck them. The train was reportedly returning from a routine maintenance ride when the accident occurred. The trains are out of service at this time due to a labor strike. However, there were several people aboard the train when the men were killed. A computer was reportedly operating the train in automatic mode.

According to BART procedure policies when someone is inspecting a track they are to work in a groups of two so that one person can inspect while the other watches for trains. There were no reports of whether or not the two workers followed that procedure. Union officials representing BART train operators, who are on strike, have expressed concern with allowing managers to operate trains as BART officials had said they would do if the operators went on strike.

This accident obviously had tragic consequences and it will no doubt leave many questions and unresolved issues for the family members of the two people killed. This is probably the best time for their family members to speak with an experienced workers’ compensation attorney in order to help them recoup all the losses that could occur because of this accident.
