California denies former NFL star's brain injury claim

No one really ever goes to work expecting to get hurt or seriously ill. However, despite companies’ best efforts, workplace accidents and injuries still occur every day in the Los Angeles area, as well as anywhere else. When a person is hurt at work he or she should be able to expect to receive workers' compensation to help pay for the medical bills as well as for time missed.

A California workers panel denied former NFL running back Tony Dorsett’s brain-injury claim, just a few months before he has diagnosed with signs of a debilitating brain disease. Doctors recently diagnosed Mr. Dorsett with the early signs of chronic traumatic encephalopathy (CTE). According reports the condition has been linked to symptoms of dementia, depression and even suicide in several men who played in the NFL.

Mr. Dorsett’s claim was denied because a workers compensation judge ruled that Mr. Dorsett had already agreed to an $85,000 settlement for other injuries. The judge ruled that because of that settlement he was no longer eligible to file any other injury claims. According to reports, the settlement means that Mr. Dorsett’s former teams are released from all future injury claims including injuries to the head.

Although Mr. Dorsett’s claim was denied in this case that does not mean that all such cases will receive the same ruling. Anyone in the Van Nuys area who feels that he or she has been hurt or fallen ill on the job should probably not waste any time in meeting with an experienced workers’ compensation attorney, who may be able to help him or her receive a fair amount of compensation.
