Representing Injured Workers Since 1955

NFL and other pro sports groups fighting to limit workers' comp

Although most employers in the Los Angeles area do their best to keep their workplaces safe, accidents and injuries still happen. When they do, employees are generally entitled to workers’ compensation for their injuries and medical expenses. However, workers’ compensation laws are often contested by employers and insurance companies.

The California Legislature is close to passing a measure to limit the amount of workers' compensation claims by out-of-state athletes. The measure has received strong support from the National Football League (NFL), as well as from other professional sports teams in the state. The latest version of the bill is expected to pass and be presented to the governor sometime in September.

California is known for its liberally interpreted workplace-injury laws, which have made it a target so-called cumulative trauma claims by players who have now retired. This is true despite the fact that many of these players have only played a few of their games in California throughout their careers. The Bill would not include those who played their entire careers with a California-based team. The governor has not said whether or not he would sign the bill.

If this bill passes it could affect several former athletes, especially those who did not spend their entire career playing for a California-based teamed but who did spend a significant time playing in the state. Workers’ compensation claims are always being challenged and many times employers and insurance companies will do everything they can to undercut those claims. For someone seeking workers comp meeting with an experienced workers’ compensation attorney is probably a good idea.
